Vitika Imports – Legal Policy

1. General

By accessing or using the Vitika Imports website, placing an order, or purchasing any product from Vitika Imports, you agree to be bound by these terms, together with our applicable Order Cancellation Policy and Return and Refund Policy.

Vitika Imports reserves the right to update these policies from time to time. The version applicable at the time an order is placed will generally apply to that order, subject to any mandatory requirements of applicable law.

2. Product Information

Vitika Imports makes reasonable efforts to ensure that product descriptions, images, prices, availability and estimated release or delivery dates are accurate.

Product images may be for illustrative purposes and minor differences may occur between images and the physical product received.

Preorder release and arrival dates are estimates and may change due to circumstances outside Vitika Imports' reasonable control.

3. Pricing and Orders

All prices displayed on the website are subject to change without prior notice, except where an order has already been accepted and applicable law provides otherwise.

Vitika Imports reserves the right to correct pricing, product description or availability errors and to contact customers where an order has been affected by such an error.

An order is subject to acceptance and availability.

4. Payments

Customers are responsible for providing accurate payment and contact information.

Vitika Imports may use third-party payment providers, including Shopify Payments or other payment processors. Transactions may therefore also be subject to the terms and conditions of the relevant payment provider.

5. Cancellations, Returns and Refunds

All order cancellations, returns and refunds are subject to the applicable Vitika Imports policies.

Preorder products are subject to the Order Cancellation Policy, including the applicable 24-hour cancellation period and reasonable cancellation charge.

Once an order has been dispatched, ordinary cancellation is no longer available, subject to any statutory consumer rights that may apply.

Customers should refer to the Return and Refund Policy for the requirements applicable to products that have already been delivered.

6. Consumer Protection

Vitika Imports operates in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, where applicable.

Nothing in these terms is intended to exclude, restrict or waive any consumer right, remedy, warranty or protection that cannot lawfully be excluded or limited.

Where a mandatory statutory right applies to a transaction, that right will prevail to the extent of any inconsistency with these terms.

7. Intellectual Property

Unless otherwise stated, all content appearing on the Vitika Imports website, including text, graphics, logos, photographs, product descriptions and other materials, is owned by or licensed to Vitika Imports and may not be reproduced, copied, modified or commercially used without prior written permission.

Third-party trademarks, logos and product names remain the property of their respective owners.

8. Website Use

Customers agree not to use the Vitika Imports website for unlawful purposes, to interfere with the operation or security of the website, or to attempt to gain unauthorised access to systems or information.

Vitika Imports reserves the right to refuse or restrict access where reasonably necessary to protect the business, its customers or the website.

9. Third-Party Services and Communications

Vitika Imports may use third-party service providers for payment processing, delivery, communications, marketing, website functionality and other business operations.

Orders, cancellation requests and other arrangements made through WhatsApp, social media, email or other third-party communication platforms remain subject to Vitika Imports' applicable policies and terms.

Communication through a third-party platform does not create separate contractual terms unless expressly agreed to in writing by an authorised representative of Vitika Imports.

10. Limitation of Liability

To the extent permitted by applicable law, Vitika Imports will not be liable for delays or failures caused by circumstances outside its reasonable control, including supplier delays, manufacturer delays, shipping disruptions, customs delays, importation issues, natural events, transport disruptions or other supply-chain interruptions.

Nothing in these terms excludes or limits liability or consumer rights where doing so would be unlawful.

11. Privacy

Personal information provided to Vitika Imports will be handled in accordance with applicable privacy legislation and Vitika Imports' Privacy Policy.

Customers are responsible for ensuring that information provided to Vitika Imports is accurate and up to date.

12. Governing Law

These terms and any dispute arising from a transaction with Vitika Imports will be governed by the laws of the Republic of South Africa, subject to any mandatory rights or protections applicable to consumers.
